By accessing or using badpeach (the "Platform"), you agree to be bound by these Terms. Use of our services implies full acceptance of these conditions. If you do not agree, strictly refrain from using the Platform.
1Eligibility and Age Requirements
You must be at least 18 years old (or the age of majority in your jurisdiction) to access this Platform. By using our services, you affirm that you meet this age requirement. We enforce a zero-tolerance policy regarding minors; any attempt to generate content involving minors or by individuals under 18 will result in immediate bans and reporting to relevant authorities.
2Prohibited Conduct
You agree to use the Platform lawfully and responsibly. The following activities are strictly prohibited and constitute a material breach of these Terms:
- Illegal Content: Creating, uploading, or distributing Child Sexual Abuse Material (CSAM/CSEM), violence, exploitation, trafficking, or content promoting extremist ideologies.
- Non-Consensual Imagery: Generating intimate images of real persons without their explicit consent (e.g., "deepfakes").
- Harassment: Using generated content to threaten, stalk, abuse, or harass others.
- Technical Abuse: Reverse engineering, decompiling, scraping, or attempting to bypass safety filters and moderation systems.
- Network Disruption: Introducing viruses, overloading our infrastructure, or interfering with the proper working of the Platform.
- Fraud: Using the service for phishing, scams, or unauthorized advertising.
3Intellectual Property and Content
Platform Content: The design, software, code, and interface of badpeach are owned by us and protected by copyright laws. You are granted a limited, non-transferable license to access the user interface.
User-Generated Content: You retain ownership of the images you generate, but you are solely responsible for them. badpeach does not view, store, or monitor individual creations unless flagged for safety. We disclaim all liability for how you use or distribute your generated content.
4User Content
"User Content" means all images, data, text, audio, video, and other material that you upload, transmit or otherwise make available through the Platform.
4.1 Your Representations
By uploading User Content you represent and warrant that:
- you are the sole subject depicted in the image(s) and you own or otherwise control all rights necessary to submit the User Content;
- the User Content does not infringe, misappropriate or violate any intellectual-property, privacy, publicity or other proprietary rights; and
- the User Content complies with Section 4.3 (Prohibited Content).
4.2 License to Us
You grant us a limited, non-exclusive, royalty-free license to host, store, reproduce, modify, adapt, create derivative works (including AI-Generated Content) and otherwise use the User Content solely for the purpose of operating and providing the Platform to you, as well as for improving our models, security, compliance and support.
Important: We never share your User Content (uploaded images) or AI-Generated Content with any third parties. Your content remains private and is only processed by our systems to provide the Platform.
4.3 Prohibited Content
You agree that you will not upload, generate or distribute via the Platform any content that:
- depicts minors (anyone under 18) in any sexual context;
- depicts any person other than yourself without that person's explicit, verifiable consent;
- promotes violence, terrorism, self-harm or hate;
- is unlawful, defamatory, fraudulent or otherwise objectionable;
- infringes any third-party rights; or
- violates any applicable law or regulation.
NSFW or sexually explicit content featuring yourself, created from your own uploaded images, is permitted provided it complies with the above restrictions and all applicable laws. You remain fully responsible for such content, including any sharing or publication.
5AI-Generated Content
- AI-Generated Content is created algorithmically and may contain artifacts, inaccuracies or distortions. We do not guarantee that AI-Generated Content will be accurate, realistic, or fit for any particular purpose.
- You acknowledge that AI-Generated Content may unintentionally produce sensitive or offensive material; you assume all risk arising from its use or publication.
- Subject to your compliance with these Terms and the payment of any applicable fees, we assign to you all of our right, title and interest in and to the AI-Generated Content we specifically create for you, excluding any underlying software or models.
- Your Responsibility. You are solely responsible for all AI-Generated Content created from your uploads, including any sharing, publication or other use. You must ensure that such content complies with all applicable laws, regulations and these Terms.
6Prohibited Use – Deepfakes and Synthetic Media
The User shall not use, and shall not permit any third party to use, the Platform for the purpose of creating, generating, modifying, or distributing any synthetic, manipulated, or "deepfake" content depicting any identifiable individual, where such content is intended for subsequent publication, dissemination, or public display, unless the User has obtained the prior, explicit, and legally valid consent of each individual whose image, likeness, voice, or other personal attributes are used or simulated. The User represents and warrants that all such consents comply with applicable laws and regulations and shall be solely responsible for any claims, damages, liabilities, or losses arising from a failure to obtain or maintain such consent.
7Tokens, Subscriptions, and Payments
Token Expiry: Tokens purchased or allocated via subscription expire at the end of the current billing cycle. Unused tokens do not roll over and are not refundable once the period ends.
Payment Obligations: You agree to pay all fees associated with your chosen plan. Failure to pay may result in immediate suspension of services.
8Refunds and Disputes
Refund Policy: Refunds are only available within 24 hours of the transaction, provided that you have used fewer than 20 tokens. Requests made after 24 hours or after exceeding the usage limit will be denied.
Chargebacks: Initiating a payment dispute or chargeback with your bank will result in the immediate termination of your account and forfeiture of all credits. We contest invalid chargebacks by providing evidence of your transaction and usage to financial institutions.
Resolution Process: Before filing a dispute, please contact support at help@badpeach.ai. We aim to resolve valid billing issues amicably within 48 hours.
9Enforcement and Termination
We reserve the right to suspend or terminate your account immediately, without prior notice or refund, if you violate these Terms. In serious cases involving illegal content, we cooperate fully with law enforcement agencies.
10Disclaimers and Limitation of Liability
"As Is" Basis: The Platform is provided without warranties of any kind, express or implied. We do not guarantee uninterrupted service or the accuracy of generated results.
No Liability: To the absolute extent permitted by law, badpeach shall not be liable for any indirect, incidental, or consequential damages (including loss of data or profit) arising from your use of the service.
11Indemnification
You agree to indemnify and hold badpeach harmless from any claims, damages, or legal fees arising out of your use of the Platform, your violation of these Terms, or your violation of any third-party rights.
12Third-Party Links
Our service may contain links to external sites not operated by us. We have no control over and assume no responsibility for the content or practices of any third-party sites.
13Modifications and Governing Law
We may revise these Terms at any time without notice. Continued use of the Platform signifies your acceptance of the updated Terms.
These Terms are governed by the laws of The United Arab Emirates. You submit to the exclusive jurisdiction of the courts in that location for any disputes.
